Terms and conditions - must be agreed to for work to commence.
- No cash no splash basis - unless organised prior with management. All work must be paid for before the vessel is returned to the water. All materials and product remain ownership of Tory Channel Contracting Ltd until paid in full.
- Where credit facility is approved - any monies outstanding for more than 30 days will incur interest calculated and compounded monthly at 10%pa. Any cost to Tory Channel Contracting Ltd with regards to monetary collection or product retrieval will be charged to the owners. Any delay in payment may result in additional cost for vessel time ashore and where the customer is in default and legal action is required the client will be liable for Tory Channel Contracting Ltd's legal costs in addition to any outstanding amounts.
- It is the owner's responsibility to advise and discuss any insurance risk with their insurer.
- High value vessels (in excess of $1million) need to ensure they have adequate cover before slipping. Tory Channel Contracting Ltd takes an all care no responsibility approach and the onus is on the owner/agent to ensure cover is appropriate and in place and that their insurer is advised where necessary.
- Any uninsured vessel owner/agent accepts total risk.
- The boat owner/agent accept there is a total liability exclusion for any consequential losses or damages.
- New build and structural alteration insurance will be on a case by case basis.
- By requesting the Repairer to carry out Works, the Customer authorises the repairer to do all acts and things that are in the opinion of the Repairer necessary or desirable to carry out and complete the Works including, without limitation;
- to operate the vessel or any machinery, part or device on or about the vessel; and
- to remove from the vessel any machinery, part or device.
- Where the customer is acting as an agent in requesting the Works, then the Customer agrees to be jointly and severally liable with its principal for all amounts payable to the Repairer arising out of the works and payable pursuant to these terms and conditions.
- Where a quote is required, this must be identified before the vessel is slipped.
- Any work requested cannot be withdrawn or ceased before completion unless mutually agreed.
- The Repairer shall be entitled to sub-contract on any terms the whole or part of the Works. Any and all acts or things that are in the opinion of the Repairer necessary or desirable to carry out and complete the Works. Liability insurance must be held by all subcontractors on site and a copy must be available.
- Tory Channel Contracting Ltd and any employee of have the right to refuse and delay any service to ensure Health and Safety standards are maintained or if the vessel is being put at a potential risk.
- I agree to photos being taken of my vessel for future setup, record purposes and inside the TCC Boats premises.
- This signed terms and conditions may be used to cover future slipping /work where no new form signed.
- I acknowledge I am informed of the current slipping fees.
